Automobile cases turn on whom was at fault and whether anyone was injured. As such, every accident has the potential to end in litigation and WHT is often asked to investigate car accidents before suit is filed. If necessary, our attorneys work with local police agencies, private investigators and accident reconstructionists to gather the information needed to document and evaluate why a particular accident occurred. WHT helps clients investigate these potential claims in an effort to help all parties reach a resolution or to narrow the issues when suit is filed.
WHT has and is presently defending lawsuits arising from car accidents in nearly every Kentucky County and the Federal Courts. We defend the liability component by listening to our clients, by contacting witnesses, and by considering other issues such as the visibility and the manner in which the road/intersection was built or the light sequence programming. At times, these other considerations turn into product liability questions about the client's vehicle, its handling, and its braking capacity or maybe even the tires. There may even be questions about our own client's medical condition and whether an unexpected or undiagnosed medical condition is the issue.
In addition to the liability questions, WHT defends the causation and personal injury components of the car accident cases by studying the impact and the injuries alleged. Our attorneys work with biomechanical engineers and medical experts of all specialties to understand the injuries alleged. We work with those same experts and vocational experts when it comes to trying to quantify an injury. In the end, we have analyzed the claim from every aspect that an arbitrator, mediator or jury would likely consider and we advise our clients accordingly.
