Trucking & Transportation Litigation
Ward, Hocker & Thornton (WHT) represents motor carriers and their drivers from claims arising out of automobile accidents. Trucking and Transportation lawsuits are similar to general automobile cases in that they often turn on who was at fault and if anyone was injured and we invite you to review the Automobile Litigation section for a discussion of that approach as it will mirror some of the considerations in Trucking and Transportation cases. However, Trucking and Transportation cases also involve more questions since the motor carrier is regulated by both the federal and state governments and the accidents are investigated by both the local policy agency and the D.O.T. Additionally, each accident raises questions about the driver's log, work schedule, training, certification, physical exams, and the manner in which the truck was serviced and maintained over its life; including if it has tracking equipment that can document the locations, miles, and speeds driven.
In Trucking and Transportation lawsuits, perception is often another issue at play. In passenger car accidents, an accident may or may not cause an injury but, in trucking accidents, there is almost a presumption that someone was injured and that the trucking company is large, wealthy and from another state. WHT attorneys are experienced in recognizing and addressing this perception and counsel our clients accordingly.
